The following terms apply to bookings of HOSTLAB GmbH accommodations made through our booking flows on residenzbadgastein.com or clubalpenresidenz.at, as well as to stays in our apartments/suites in Bad Gastein. By completing your booking, you confirm that you have read and agree to these payment and cancellation terms, our house rules, and our General Terms & Conditions.

1. Payment and Cancellation Terms

The following payment and cancellation terms apply uniformly to the following properties:

Residenz Boutique Suites, Kaiser-Wilhelm-Promenade 1, 5640 Bad Gastein

Club Alpenresidenz Gastein, Karl-Heinrich-Waggerl-Straße 2, 5640 Bad Gastein

Payment

The full accommodation price (100%) is due as prepayment at the time of booking. The booking becomes binding upon receipt of full payment.

Cancellation

Free cancellation up to 7 days before arrival (11:00 a.m.). In the event of late cancellation, early departure, or no-show, the full accommodation price will be charged at 100%.

Overnight tax (formerly "Ortstaxe" / "Kurtaxe")

In addition to the accommodation price, a statutory overnight tax is payable for each overnight stay in Bad Gastein pursuant to the Salzburg Overnight Tax Act (Salzburger Nächtigungsabgabengesetz, SNAG). For all guests aged 15 and over, the overnight tax is €4.00 and the mobility contribution (incl. the guest public-transport ticket) is €0.50 per person and night. From the 4th night, a one-time research institute levy (Forschungsinstitutsabgabe, FIB) of €1.10 per person (aged 15 and over) is additionally charged. Children and adolescents up to the completed age of 15 are exempt from the tax. The tax is collected on site.

2. No statutory right of withdrawal for accommodation

For contracts covering accommodation services concluded for a specific date or period, there is no statutory 14-day right of withdrawal ("right of revocation") pursuant to § 18 para. 1 no. 10 of the Austrian Distance and Off-Premises Business Act (Fern- und Auswärtsgeschäfte-Gesetz, FAGG). The cancellation of your booking is governed exclusively by the cancellation terms set out under Point 1.

3. House Rules

Our house rules apply to all properties. By making a booking, you confirm that you have read and agree to them. In the event of violations, we reserve the right to terminate your booking immediately and to claim compensation for any damages or costs incurred.

Check-in / Arrival

Check-in is possible on the day of arrival from 3:00 p.m. (Club Alpenresidenz Gastein) or from 4:00 p.m. (Residenz Boutique Suites). Three days before arrival, we will send you a link for online check-in, where you will receive the door code and all access information. Check-out times can be found under Point 5.

Damage deposit

During online check-in, we ask for a damage deposit of €100.00 per apartment via PayPal or credit card. The deposit is merely "blocked," not charged, and released again approximately 24 hours after a satisfactory check-out.

Quiet hours

Our houses are located in the heart of a lively but peaceful spa town. Please respect the night-time quiet from 10:00 p.m. onwards — out of consideration for your fellow guests and our neighbors. Loud music, disruptive noise in outdoor areas, or parties are not permitted after this time.

Events or parties of any kind are only possible following prior arrangement with us. Without authorization, and in the event of disturbance of the peace, we will charge a flat fee of €1,000.00. Any further claims for damages are reserved.

Occupancy

Only the persons stated at the time of booking may stay in your unit. Please clarify any exceptions with us in advance — we can usually find a straightforward solution. In the event of violations, we reserve the right to terminate the stay and retain the deposit.

Video surveillance

For security reasons, surveillance cameras are installed in the public areas and stairwells. By entering the building, you consent to being recorded.

Dogs and pets

Well-behaved dogs are warmly welcome following prior registration. The dog fee is €20.00 per night and is charged at the time of booking or at check-in at the latest. Please always keep your dog on a leash inside the building and be especially considerate of other guests in the communal areas. We reserve the right to refuse dogs that endanger the well-being of fellow guests through aggressive behavior, persistent noise, or other disturbances.

Other pets are not permitted. If a pet is kept in the unit without prior authorization, we will charge a flat special cleaning fee of €200.00; any damage beyond this will be charged at replacement value.

Parking

A limited number of private parking spaces are available at both properties (€10.00 per night). A space can be requested in advance or during your stay; due to limited capacity, there is no entitlement to a private parking space. Reservation requires that you provide your vehicle registration number. At the Club Alpenresidenz Gastein, public parking is also available nearby, as is a secured parking garage approx. 500 m away. Please observe the road traffic regulations and never block our neighbors' driveways — not even briefly.

4. Damage, Loss, and Violations

Each unit has been furnished with great attention to detail and high-quality inventory. Please inspect your unit when you first enter it. We will inform you of any existing damage in advance and/or post a notice. If you notice any defects or damage yourself, please report them to us immediately. In the event of damage caused by improper use, we reserve the right to charge the replacement value.

When checking out, please ensure that all inventory items remain in the unit. Items accidentally taken (e.g. Bluetooth speakers, decorative objects, or other inventory) will be charged at replacement value plus a reasonable handling fee.

The door code provided at check-in may only be shared with fellow traveling guests. If the code is passed on to third parties, we reserve the right to terminate the booking with immediate effect.

We enforce a strict anti-drug policy. The consumption of any drugs — including cannabis — is not permitted anywhere on the premises or in the units.

Barbecuing and the use of water pipes ("shishas") are prohibited for fire-safety reasons — including merely bringing them into the units. In the event of a violation, we will charge €200.00.

No-smoking policy

Smoking (including e-cigarettes) is not permitted in the units or anywhere in the building; smoking is only allowed in the designated outdoor area. All units are equipped with smoke detectors. In the event of a violation, we will charge a special cleaning fee of at least €200.00.

5. Return of the Unit (Check-out)

Check-out must take place on the day of departure by 10:00 a.m. (Club Alpenresidenz Gastein) or by 11:00 a.m. (Residenz Boutique Suites). On request, we are happy to store your luggage in our luggage room until your departure.

The final cleaning is included in the accommodation price. For heavily soiled units (including odor nuisance), we charge a special cleaning fee of €100.00.

Violations of our house rules may lead to immediate termination of the stay. In such cases, a refund of the accommodation costs is excluded.

6. General Terms & Conditions

6.1 Scope and provider

These General Terms & Conditions govern the use of the websites and booking flows of HOSTLAB GmbH (residenzbadgastein.com and clubalpenresidenz.at) as well as the formation and performance of accommodation contracts. By accessing the website or completing a booking, you agree to these terms. Please do not continue to use our services if you do not agree with all of the terms set out here.

6.2 Definitions

"Customer," "guest," "you," and "your" refer to the person making a booking or using the website. "HOSTLAB," "we," "us," and "our" refer to HOSTLAB GmbH. "Party" or "parties" refers to the customer and/or us. Terms in the singular, plural, or in different spellings are interchangeable and refer to the same thing.

6.3 Copyright and use

Unless otherwise stated, the rights to all content on our websites (texts, images, graphics, layout) belong to HOSTLAB GmbH and/or its licensors. All rights reserved. Use for personal purposes is permitted within the restrictions set out here. In particular, you may not:

republish website content,

sell, rent, or sublicense it,

reproduce, duplicate, or copy it,

distribute it.

6.4 Guest reviews and comments

Parts of the website may offer users the opportunity to post opinions and information. Comments are not pre-filtered, reviewed, or approved by us and do not reflect the views of HOSTLAB GmbH, but rather those of the respective authors. To the extent permitted by law, we are not liable for comments or any damages arising from them. We reserve the right to monitor comments and to remove any that are inappropriate, offensive, or unlawful, or that violate these terms.

By posting a comment, you warrant that you are entitled to do so, that you do not infringe any third-party rights (in particular copyright, trademark, or personality rights), and that you do not post any unlawful, defamatory, or offensive content.

6.5 Warranty and liability

The statutory warranty provisions (Austrian Civil Code, ABGB) apply, as do — vis-à-vis consumers — the mandatory provisions of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG). For damages arising from slight negligence, we are liable to consumers only in the event of injury to life, body, or health, and in the event of breach of essential contractual obligations; otherwise, liability for slight negligence is excluded. We assume no liability for events of force majeure (e.g. natural events, official orders, failures of supply infrastructure such as electricity, water, or internet for which we are not at fault). Mandatory statutory liability provisions remain unaffected.

6.6 Data protection

The processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (Datenschutzgesetz, DSG). Details can be found in our privacy policy on the respective property website (residenzbadgastein.com or clubalpenresidenz.at).

6.7 Applicable law and place of jurisdiction

Austrian law applies, excluding its conflict-of-law rules under private international law and the UN Convention on Contracts for the International Sale of Goods (CISG). If the customer is a consumer with habitual residence in the EU, the mandatory consumer protection provisions of their country of residence remain unaffected. The place of jurisdiction for actions against or by consumers is governed by the mandatory provisions (§ 14 KSchG, Brussels Ia Regulation / EuGVVO); for disputes with businesses, the jurisdiction of the competent court in Salzburg is agreed.

For out-of-court dispute resolution, the European Commission provides an online platform (ODR platform): https://ec.europa.eu/consumers/odr. We are not obliged and are generally not willing to participate in dispute resolution proceedings before a consumer arbitration body.
